NJBIZ - Pharma Fight over Heartburn Drug
Wyeth Pharmaceuticals last week filed a patent infringement lawsuit against Teva Pharmaceuticals USA Inc. for launching a generic version of Wyeths acid-reflux drug Protonix. But Teva says it won 180 days of marketing exclusivity from the U.S. Food and Drug Administration for 20-milligram and 40-milligram doses of pantoprazole sodium delayed release-or generic Protonix DR-tablets.

Wyeth says its Protonix patent does not expire until July 2010 and may be extended until January 2011. Wyeth is suing Teva for lost profits and other damages and seeks to permanently stop future sales of generic Protonix until the patent expires.
